How is this different from an Independent Contractor Agreement?

The Employee Policy Package is for W-2 employees - workers who are on your payroll, receive benefits, and are subject to your direction and control. The Independent Contractor Agreement is for 1099 contractors who are not employees. Misclassifying employees as contractors (or vice versa) carries significant tax and labor law exposure. We can help you classify correctly.

When does my Florida business need an employee handbook?

Once you have any W-2 employees. A handbook is the single most effective document for documenting at-will status, communicating expectations, providing required Title VII / FCRA / FMLA notices, and creating a defensible record if a dispute arises. Several federal anti-harassment defenses (such as the Faragher / Ellerth defense) require that employers maintain and distribute a written policy with a complaint procedure. Without a handbook, those defenses are unavailable.

Does the package include FMLA and other federal provisions?

Yes, where applicable. We include FMLA leave provisions for employers with 50 or more employees within 75 miles, ADA reasonable accommodation language, USERRA military leave, and Florida-specific leave provisions. For smaller employers we tailor the leave section to your headcount and avoid creating obligations the law does not impose on you.

What about employees in other states?

This package is drafted for Florida-based workforces. If you have employees in other states, we can provide a quote for multi-state addenda or a separate handbook tailored to that state's employment laws (California, New York, and other plaintiff-friendly jurisdictions especially). Will the handbook protect my at-will employment relationships?

Yes. Florida is a strong at-will employment state. We include explicit at-will language, an integration clause that prevents oral modifications, a separate at-will acknowledgment for employees to sign, and disclaimers throughout that the handbook is not a contract of employment. Past results do not guarantee future outcomes; enforceability depends on consistent application of policies.

Can you update my existing handbook instead of starting from scratch?
